The risk we run in this Forum and dealing with all these stories is that, for some individuals, a desensitization to rape can set in. Like video game violence, we might become a bit more callous about real rape, and--worst yet--tempted to actually do it. Few of us, I wager, have spouses/partners who really dig seriously rough role-play, so count yourself lucky Pop54!
If the girl was underage* then she was raped, regardless of her behavior. The fact that she was a shameless flirt might factor in the judge's sentencing as a "mitigating factor," but it doesn't excuse it. On the basis of the facts applied to the defined charge(s), the jury apparently did the right thing.
Here in the USA there has been a disturbing trend of "jury nullification," especially where race is involved. O.J. Simpson is the biggest example: guilty as sin, but the jury persuaded to let him off because the bleach-skinned dickhead (who spurned Blacks in every aspect of his life) was--for this case, anyway, "minority."
