    Arrow All Photos will now be moderated

    they will be viewed to make sure there are no copyrights on the Pictures before they are approved---also Hot Linking has been disabled as this is stealing bandwitth----and when a site stops it from happening all that appears here is red Xs---so if you try to hotlink a picture all that will show up is the web address for that picture--

    PS in a few weeks I will be going thru all the pictures already posted deleting any that have copyrights on them

    Well I have been informed that some members had permission to post copyright Photos-----So to be fair ---I am not going to delete any for 60 days---this will give you and me time to figure this out----

    this is the way I want to handle it---I will create a log in the Moderators forum for Members who have permission to post copyrighted photos---they will be issued a permission number----that must appear in their posts--

    To get a permission number PM me---and I will either grant you permission or not---and tell you why

    to be able to post Copyrighted photos you must be the holder of the copyright---The pictures are yours----or provide me with some kind of proof you have express written permission to post others copyrighted pictures
    (like a copy of the written permission)


    I feel that in creating this log and permission system in the Moderators Forum that future misunderstanding will be avoided --no matter who the Admins or Moderators are in the future---and all Members treated the same---

    Now the members who have already posted copyrighted pictures need to apply for this permission within the 60 days or the existing pictures will be deleted

    From this point on I will not approve a copyrighted picture unless the member has permission to post it

    Hope this sounds fair to you ---it was the best I could work out under the conditions I have been left with

    For example, let's say someone wants to post a picture of themself or with permission a partner, the person who owns that photo and the right to the image, holds the copyright, even if they don't mark the photo as such.

    A good example, is Barton's recent posting of Kat with her new sexy collar. Barton and Kat are the copyright holders of that photo. Just because it was posted on the web, doesn't mean it is fair game to be copied, distributed, etc.

    Rabbit, are you wanting any member to contact you before posting any personal picture? Or are you specifically calling out images where a (c) copyright to someone has written on the photo, or it's clearly artwork that belongs to someone other than the poster - like say a well known cartoonist's photos or images from say artmam?

    There is a little loop hole in the law you just quoted ---but the basic facts are true---even though they may not hold up in court. Notice in the law you quoted it says "Generally", owners of copyright have the exclusive right to use and copy their works. Copyright owners can also authorize others to use their works. The use or copying of any work without permission from the owner of the copyright is a violation of the United States Copyright Act.

    And that "Generally" has been found to be really broad in the few court cases that I have monitored. Over 90% of them were found not to own the exclusive rights to pictures, that were not marked or registered as such ---and were posted on a public internet site--


    I am specificly saying for anyone to post a picture with a copyright mark on it ---they will have to have permission from me---You see without a copyright mark ---neither Tiger or I can tell who the photo belongs to so the liability is with the poster----If it has a copyright mark on it---then the liability lies with Tiger---and ---Rabbit1

    Right, sooooo, if we DO post a picture of ourselves, and if we put the little 'c' next to it, the picture is exclusively ours, not to be taken out of the library? LOL

    Of course, it's not that simple, it needs to be legally copyrighted , but, it is common decency to ask permission to recopy a posted 'anything'.

    Question is: If we link to a picture from another site, do we necessarily need to send a written permission to you before you allow us to post it here?

    Most people on the net, generally follow the "common decency' rule that I just stated.

    What about the sites that host pictures......such as Photobucket? That's linking, isn't it?

    if you post a link to another site --then that site has to hold the permission of the copyright. and is not our problem--just make sure you post a site link not a particular picture link

    as far as host like Photobucket---I am hoping you would only link to your pictures on Photobucket----and yes I said post a link as hotlinking a picture is no longer allowed----and use the common decency rule by not posting others photobucket links----and if you have a copyrighted picture on photobucket and link it here ---yes I need to have some sort of permission to host such a picture on this site.

    Actually you dont even need to put the C next to it, it used to be the case in the american law to do it but not anymore. There is a list of (from the top of my head) 54 countries who are all involved in the convention that says that every picture you make, every painting, video etc. is copyrighted to you (owner being the one who made it, not the person on it). Everything you make is your own intellectual property and you dont need to put any (c) or brand on it to mark it as such. You may do it of course, but you dont have to.

    What happens if you post the pic but you are not in an America? whose law do you use, the country the server is in, or the country the copy right was violated in?

    what if you were to remove all copy right marks and site address and the post the pics? (not saying i will just curious)

    the server is located in the USA and we go by US laws---Removing copyrights is no legal---so you do that at your own risk --if we do not see the copyright guess we do not know it is copyrighted ---and the poster takes all legal responsibility for their actions

    ID... sorry for the delay but I wanted to make sure I fully understood, based on the new rules, before answering.

    As stated in the new rules:

    4. Pictures:
    Underage: NO underage photos, clothed or naked, may be posted. Regardless of whether it’s your 5th birthday party at Aunt Jane’s house, or whether it’s child porn, they will be removed from the site.
    Copyright: No copyrighted photos may be posted without permission of owner. The responsibility of copyright is in your hands not the sites.
    Embedded Links: No embedded links are allowed on pictures.
    Which means that copyrighted photos may be posted but it is clearly stated that the person posting will be responsible for any copyright infringement, etc. and not the site. IF the photo is embedded it will still be removed.
